Using noncopyrighted images during blogathons

Hi everone,

Have a question for those who know something about using images in blog posts (I know there are many here who are much more knowledgeable than I am).


I'm starting to participate in a lot of blogathons from this month, most of them related to classic films (since I post weekly about classic films also). My blog is on my author website and although I'm not promoting anything right now (since won't be releasing my first book until spring 2016), I will be in the future and I do write about topics that are sometimes directly related to my writing and sometimes I reference my Books page on my author website. Right now, that doesn't have any buy buttons, since nothing has been released, but it will in the future. So I think that puts my blog in the promotion/marketing category.


Because of this, I am extremely picky about the images that I use, since the last thing I want is to infringe on someone else's copyright. I always check and double check that my images are CC and/or PD and I always include all the info needed to show where I got the image from, including hyperlinks.


However, a lot of the classic film blogs I subscribe to don't have the same protocol. They seem to use many images that I know for a fact are not CC/PD (because I've seen them around the web and I know they are copyrighted) and they usually don't include even a link to where they got the image, let alone the citation. My guess is that they don’t have to worry about copyright because their blogs are more for fun and not linked to anything that might be considered promotion or marketing. So their use of the images comes under the fair use laws.

I'm concerned because these blogathons want me to include their banners and many of these banners include images that I know or believe are copyrighted. I'm worried that if I include the banner, even with a link to the original blogger's blogathon announcement, I'll be at risk for infringing copyright, even though I'm not the one who originally used the copyrighted images.

So should I just omit putting the blogathon banner on my blog and include a hyperlink to the blogger's blog (which I'm inclined to do)? Or is it OK for me to use the banner as long as I link to the blogger's site to show that it's on their heads and not mine if the images aren't OK to use?
